Brief Description

The purpose of this document is to adopt government-wide terms and conditions for grants to state and local governments. In 1987 the President required the issuance of a Common Rule to adopt government- wide terms and conditions for grants to state and local governments. Applicability to Indian tribal governments was added later. The Grants Management Common Rule is typically “incorporated” into a sponsored agreement (grant, contract or cooperative agreement) by reference either in the award document itself or in the governing agency rules and regulations in the Code of Federal Regulations (CFR) that include the Grants Management Common Rule. However it is incorporated; it is an offi cial “compliance document.”

The Common Rule provides guidance to Federal agencies on the administration of grants to and agreements with state, local and Indian tribal governments including standards for obtaining consistency and uniformity in the agencies’ administration of those grants and agreements. The Common Rule applies primarily to “assistance agreements” (grants and cooperative agreements), not contracts. Except as provided, the standards are applicable to all Federal agencies. If any statute specifi cally prescribes policies or specifi c requirements that differ from the standards provided in this part, the provisions of the statute shall govern. Recipients shall apply the provisions of those sub-parts to sub-recipients performing substantive work under grants and agreements that are passed through or awarded by the primary recipient, if such sub-recipients are organizations described in paragraph (a) of this section.
